Medicaid does not provide medical assistance for all poor persons.
Even under the broadest provisions of the Federal statute (except for emergency services for certain persons), the Medicaid program does not provide health care services, even for very poor persons, unless they are in one of the designated eligibility groups. Low income is only one test for Medicaid eligibility; assets and resources are also tested against established thresholds.

 

Elder law is one of the newest and fastest growing specialties in the legal profession. It combines elements of Estate Planning, Wills and Trusts, Conservatorship, Health Care Planning and Medicare/Medicaid Planning. It draws upon the experience of elder law attorneys representing older clients in legal decisions affecting their eligibility for disability, social security and other public benefit programs including services supported by the Older Americans Act.

The older population, persons 65 years or older, numbered 35.9 million in 2003. They represented 12.3% of the U.S. population, about one in every eight Americans. By 2030, there will be about 71.5 million older persons, more than twice their number in 2000. People 65+ represented 12.4% of the population in the year 2000 but are expected to grow to be 20% of the population by 2030.
